I James Nickels Sr. of the County of Scott & State of Virginia, do hereby make my last will and testament in manner & form following that is to say

1st After the payment of all my just debts & funeral expences, I give to my wife Cerena all my estate both real & personal untill the youngest child that she has or may have by me becomes twenty one years old or during her her widowhood or natural and virtuous life.

2nd I desire at the time the youngest child refered to in the first clause, becomes twenty one years old or my wife marries or acts unvirtuously which ever may happen first that my wife Cerena have one third of my real estate & that my children by my wife Cerena, to wit Mary Ann, Loucinda C. Hannah E, George W. Dulaney, Matilda J, Boenerges, Martha & any other or others she may have by me, have a full and equal shear in all my real & personal estate.

3rd I give to my Children by my first wife to wit to my son William I give ten dollars, to my son James I give ten dolalrs, to my daughter Cindarilla ten dollars, to my son Walter H. I give ten dollars, to my son Allen I give ten dollars, to my son Brooks I give ten dollars, to my daughter Elizabeth ten dollars, to my daughter Mary I give ten dollars & to my son Matthias twelve dollars & fifty cents to be paid to them in twelve months after my decease.

And lastly I do hereby constitute and appoint my friend Francis Fugate executor of this my last will and testament hereby revoking all other or former wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand and affixed my hand & seal this 9th day of November 1860.

Matthias Nickels, Sr. - February 10, 1836

Probated June 1838 in Knox Co., TN

The Last will and Testament of Matthias Nickle having been produced to court for probate whereupon John McMillan and Charton Mitchell subscribing witnesses thereto came into open court who being qualified say they are acquainted with the Testator Matthias Nickle and that they saw him sign and seal said Testament at the date thereof and that at the time of signing the same he was of sound mind and disposing memory to the best of their knowledge & beliefs Therefore said will was admitted to record and is in the words & figures following to wit

State of Tennessee

Knox County 10 Feby AD 1836

I Matthias Nickle of the aforesaid place do hereby will and dispose of my property in the following manner. First I allow to my wife Elizabeth Nickle all my property real and personal of every discription. That is to say if she should outlive me so long as she remains my widow to be used by her in in any way for her comfort and convenience or to change it or if necessary to dispose of it and after the death or intermarriage of my wife if any of my goods and chattles should remain unused by her my will and desire is that it be divided equally between my two children viz Sally & William but to none else as I have heretofore divided and apportioned to my other children as far as my circumstances enabled me to divide My will and pleasure is that if any or all of my land should remain unused by my wife that at her death or intermarriage it should be the property of my son William and should I outlive my wife my will and desire is that my property at my death shall go to my two children viz Sally and William in the same way and manner as above directed and to none else.

And I hereby appoint my wife and my son William to Execute this my last will and I do hereby revoke all former wills by me made.

The foregoing will having been proved in open court and admitted to record wherein Elizabeth Nickle & William Nickle were appointed Executrix and Executor the said William Nickle came into open court and was duly qualified as Executor and entered into bond with the security conditioned as prescribed by law & letter of testimony awarding -

To William Nickle Greeting-

Whereas at our County Court held for the County of Knox at the courthouse in Knoxville on the first Monday of June 1838 it appearing to the court that Mathias Nickle late of said county had dec'd first having made his last will and testament in which Elizabeth Nickle & William Nickle was appointed Executrix and Executor and the will having been proved and admitted to record and the said William Nickle qualified as Executor It was ordered that letters testamintry issued We therefore empower the said William Nickle to take into his possession all and singular the goods and chattles rights and credits of the said testator wherever the same may be found and all last debts of said testator and all the legacies specified in said will will and truly to pay as far as the said goods and chattles rights and credits may extend and in all things to administer said good and chattles rights and credits according to the terms of the will and law of the land
